Short Note : 1. This revision is directed against an award of compensation made by the District Judge, Jabalpur, under Section 16 (3) of the Telegraph Act, 1885, read with section 42 of the Electricity Supply Act, 1948. The Madhya Pradesh Electricity Board, which is the non- applicant in this revision, has erected 17 electric poles in the lands belonging to the applicant. The area occupied by the Electricity Board in erecting the poles comes to 1,700 sq. ft. The District Judge awarded Rs. 92/- as compensation to the applicant. 2. The learned counsel for the plaintiff-applicant submits that the District Judge should have awarded Rs. 200/- as compensation and the amount awarded is too low. Shri Nair, who appears for the non-applicant-Board agrees that Rs. 200/- should have been awarded as compensation to the applicant. Revision allowed.
