Short Note : 1. This revision is directed against an order by which the trial Court has come to the conclusion that Devendra Kumar from whom the defendants claim title to the land in suit is not a necessary party and need not be joined. Held : The plaintiff-non-applicant claims the land from one Trimbakrao. Similarly, the defendants-applicants claim the land from Devendra Kumar. The persons through whom the panics claim may be important witnesses to decide the question of title, but they are certainly not necessary party. The suit can proceed in their absence. The trial Court came to the correct conclusion. Revision dismissed.
