Short Note : 1. This revision is directed against an order by which the trial Court has refused maintenance to the plaintiff - applicant during the pendency of a suit for partition. Held : The estate of which the partition is claimed by the plaintiff-applicant belonged to one Nathusingh deceased. The plaintiff is claiming share in the property of the deceased under a will. The defendants, who are natural heirs, have disputed the will. Thus the plaintiff's position as co-sharer is not admitted. In the circumstances, the trial Court was right in dismissing the application for interim maintenance. Interim maintenance in a suit for partition can be allowed to a plaintiff in case his position as a co-sharer is either admitted or is obvious. In the instant case, unless the will is proved, it cannot be said that the plaintiff is a co-sharer. Revision dismissed.
