Short Note : 1. This revision is by the defendant and is directed against an order dated 27th July 1977 by which the trial Court adjourned the hearing of the suit on defendant's application on the condition of payment of Rs. 100/- as costs. 2. Learned counsel for the applicant submits that the award of Rs. 100/- as costs is not justified and the amount of costs is exorbitant. Award of costs is within the discretion of the Court. But like any other judicial discretion, this discretion has also to be reasonably exercised. Learned counsel for the plaintiff-non-applicant agrees that the proper amount of costs ought to be Rs. 50/- only. In view of the stand taken by the learned counsel for plaintiff non-applicant, the costs awarded must be reduced to Rs. 50/-. Revision party allowed.
