Short Note : 1. This is a defendant's revision and is directed against an order by which certain preliminary issues have been decided by the trial Court. 2. The grievance of the defendant-applicant is that the trial Court should have given opportunity to lead evidence on these issues before deciding them. Learned counsel for the defendant submits that as the preliminary issues need evidence. All the issues should have been decided together after the parties had led evidence. Learned counsel for the plaintiff-non-applicant has no objection if the so-called preliminary issues are decided along with the other issues after the parties had led their evidence on all the issues. Held : In view of the stand taken by the learned counsel for the parties the revision is allowed. The order deciding issues Nos. 8. 10, 16 and 17 as preliminary issues is set aside. These issues shall be decided along with the other issues after the parties had led their evidence on all the issues. The parties shall appear before the trial Court on 26th September 1977 for taking direction for further progress of the suit. The record of case be sent forthwith. There will be no order as to costs of this revision. Revision allowed.
