Short Note : 1. The ex-parte decree was set aside by the trial Court subject to payment of costs of Rs. 40/- within 7 days from the date of the order and accordingly, the proceedings were fixed for 23.1.1975. The aforesaid date happened to be a holiday. The next working day was 27.1.1975. The amount of costs was tendered on the opening day, but the other side refused to accept payment on the technical ground that the period of 7 days had already expired. The applicant, therefore, applied to the trial Court for extension of time. The request was refused by observing that since the time limit fixed had already expired, the order directing restoration had lost its force and could no more be availed by the applicant. 2. In the facts and circumstances of the present case, this Court is of the opinion that the order made by the Court below refusing to extend the time for payment of costs results in miscarriage of justice. On behalf of the non-applicant, nothing could he shown to justify the same. Revision allowed.
