Short Note : 1. The plaintiff applicant sought to challenge the order made by the trial Court holding that one Mst. Panna, being the widow of late Shivprasad and one Mst. Mahrajua being his daughter, were necessary parties to the suit and therefore, shall be accordingly impleaded. Held : On perusal of the order impugned and on going through the pleadings, this Court finds that the order made by the trial Court deserves interference. The facts whether Mst. Panna was the widow and Mst. Maharajua the daughter of Shiv prasad were seriously in dispute. In order to decide the question whether they were necessary parties, it was necessary to decide the alleged relationship as referred above. The trial Court observed that the fact whether they were so related or not will be decided afterwards. Case remanded. Revision partly allowed.
