1977-09-30

S.R.VYAS

body1977
Short Note : 1. Plaintiff applicant had filed a suit against the non-applicant for recovery of a loan. The claim was denied on various grounds. One of the grounds raised was that the plaintiff was a money lender, and the suit was not maintainable because the plaintiff had not filed money lender's certificate. The trial Court dismissed the suit. Held: In this Court the applicant filed a certificate of registration under the Money Lenders Act, and prayed that the suit should be remanded back to the lower Court for admitting the certificate in evidence for deciding the suit on merits. This prayer of the applicant deserves to be allowed in view of the decision of the Court in Smt. Janki Bai Chunnilal v. Ratan, 1961 JLJ 1389, relied on. Revision allowed.
