Short Note : The application submitted along with the appeal for condonation of the delay stated that the Government's decision to file the appeal was communicated to the Government pleader on 24th February 1970 and in communicating this decision some delay was caused. It is further stated in this application that even after 24th February 1970 it took time upto 5th March 1970 for the Government to collect the amount of Court-fees. Apparently, none of these reasons could he said to be sufficient for condoning delay under section 5 because for the first reason that the Government took longer time than what the limitation is to arrive at a decision to prefer an appeal, they should thank themselves. It only indicates the slackness on the part of the officers who handled the matter. Similarly it could not be believed that the State Government could not collect the funds necessary for payment of Court-fee up to 5th March 1970. Therefore this ground also cannot he accepted. It appears that it is because of these reasons that no affidavit in support of this application could be filed as no officer probably was prepared to take the responsibi1ity of supporting such an application. Appeal dismissed.
