Short Note : The appellant Madkami Hurra had been convicted under section 302 of the Indian Penal Code for the murder of his father Madkami Kosa and sentenced to imprisonment for life. Held : The appellant normally would have been held liable for the murder of the deceased under section 302 of the Code, but the evidence of extra-judicial confession, which has been accepted, goes to show that the offence was committed in a sudden quarrel or under grave and sudden provocation. The appellant’s father had slapped the appellant. Thereupon the appellant caused the injuries to his father in a sudden quarrel. The slaps received by the appellant may also constitute grave and sudden provocation, having regard to the social background of the appellant. In the circumstances, the appellant's offence is reduced to one punishable under section 304 (Part I) of the Code. Appeal partly allowed.
