Short Note : 1. By this petition under Articles 226 and 227 of the Constitution the petitioners are praying for issue of a writ of certiorari for purposes of quashing the orders (Annexure P-3 and P-4 respectively) passed by the Sub-Divisional Officer-cum-Competent Authority (respondent No. 3) and the Board of Revenue (respondent No. 2) (Annexure P-3 and P-4). 2. Before the petition could proceed for final hearing, a preliminary objection was raised by Shri Dixit, Deputy Government Advocate, that in view of the fact that the original holder of the land, Arjunsingh, not having been joined as respondent in the present petition, although he was a party in the proceedings before the lower authorities, this petition is not maintainable in the absence of necessary parties because no relief can be given to the petitioners as Arjunsingh is not before this Court. Learned counsel for the petitioners prayed for grant of time to join Arjunsingh as respondent in the present petition. The petition has been fixed for final hearing today and no reasons have been given for not joining Arjunsingh as a party to the petition when be had been a party all through. We are, therefore of opinion that in the absence of Arjunsingh this petition cannot be proceeded with and is liable to be dismissed on that count. Petition dismissed.
