Short Note : 1. The revision had been filed against an order passed by the Civil Judge Class II, Indore ordering appointment of Shri S.M. Marfatia as the Commissioner. 2. It could not be disputed that in such matters a person with whom either party has no grievance should have been appointed as Commissioner. It is also not in dispute that both the parties did not agree to one name before the Court below. However, both learned counsel appearing before the Court have agreed to one name. Case remanded. Revision allowed.
