Short Note : 1. It is now settled that the term 'dispute' as used b sub-section (2) of section 13 of M. P. Accommodation Control Act, 1961 includes the dispute either with respect to the quantum of monthly rent or the arrears of rent due or both and in case any such dispute is raised the operation of section 13 (1) is arrested and the Court is bound to fix the provisional rent In a case where the dispute is with respect to the quantum of monthly rent it would relate to the arrears of rent payable as well and, therefore, in that case the operation of the entire sub-section (1) of section 13 would be arrested. But in the instant case there was no dispute as regards the quantum of monthly rent. The only dispute between the parties was with respect to the arrears of rent payable on the date of the suit. Therefore, the question which arises for consideration is whether on account of the said dispute even the second part of sub-section (1) of section 13 was arrested and as the trial Court failed to fix the provisional arrears of rent payable, the appellant was not bound to deposit or pay the monthly rent by the 15th day of each English calendar month. In the opinion of this Court in the absence of the dispute as regards the quantum of monthly rent the appellant was bound to comply with the provisions contained in second part of sub-Section (1) of section 13 by depositing the monthly rent regularly on or before the specified date. It is not disputed that the appellant did not comply with she said provisions and hence he cannot seek the protection of sub-section (5) of section 13 to avoid a decree for eviction under section 12 (1) (a) of the M.
