Short Note : 1. The petitioner was a temporary surveyor in the forest department. He went on leave on 17th October 1971 and resumed duty on 1st May 1972. 2. Held: The main question is whether the petitioner's temporary service as Surveyor automatically terminated under rule 16 (2-a) of M.P. Revised Leave Rules, 1934. The learned counsel for the petitioner contends that the petitioner was entitled to six months' leave including extra-ordinary leave as provided in sub-clause (ii) of rule 16 (2) of the Rules. Even so the petitioner resumed duty after expiry of six months and, therefore, the case would be governed by rule 16 (2-a) The petitioner went on leave on 17th October 1971 and resumed duty on 1st May 1972. The petitioner thus resumed duty after expiry nearly 6-1/42 months. Sub-rule (2-a) of rule 16 was thus attracted and the petitioner would be deemed to have resigned his appointment and ceased to be in Government service after the expiry of six months from 17th October 1971. petition dismissed.
