JUDGMENT V. Kumar, Chairman. - This is a reference under section 218 of the U.P. Land Revenue Act in a case of mutation made by the Additional Commissioner, Meerut dated November 6, 1974 recommending that the order of the trial court be set aside and the mutation be ordered in favour of the revisionists. 2. Briefly stated the facts of the case are that Satpal executed a sale-deed dated October 22, 1973 in favour of Mohd. Ismail and other in respect of plot No. 2-M (2 Bighas 7 Biswas 4 Biswansis). On the basis of this sale-deed Mohd. Ismail and others applied for mutation of their names over the land in dispute. Hashmat filed objections on the grounds that the vendor Satpal had entered into a contract of sale in respect of the plot in question with the objector much prior to the impugned transaction. The vendor is in possession over it. After considering the evidence of the parties the trial Court rejected the mutation application. Being aggrieved by this order of the trial court Mohd. Ismail and others went in revision before the Additional Commissioner, Meerut who has recommended that the order of the trial court be set aside and the mutation be ordered in favour of the revisionists. 3. The opposite party is neither present nor represented by any counsel. I have, therefore, heard the learned counsel for the revisionists and gone through the records of the case. 4. It is an admitted fact that Mohd. Ismail land others recorded contenants alongwith the vendor Satpal and the objector Hashmat is the father of 2 others recorded co-tenant. The possession of one co-tenant is possession of all. The vendor has executed a registered sale deed giving delivery of possession to the revisionists. The names of the revisionists should be mutated over the land in dispute. There was only an agreement to sell and that agreement is not a registered document. The learned Additional Commissioner has rightly recommended for allowing mutation in favour of the revisionists. I agree with him. 5. In the result, I accept the reference, set aside the order of the trial court dated June 12, 1974 and order that the name of the revisionists Mohd. Ismail and others be mutated over the land in dispute.
