Short Note : 1. The question that arose for consideration was whether a wife in whose favour an order of maintenance was passed under the old Code and who later on was divorced before the coming into force of new Code, is entitled to enforce that order of maintenance after the coming into force of the New Code. Held : The order dated 19-9-1973, granting maintenance in so far as respondent No. 1 Mst. Iqbal Suraiya Begum was concerned being not in force immediately before the commencement of the new Code, the same would not be covered by the saving clause in section 484 of the new Code. That being so in absence of a valid order the question of enforcing the same for recovering maintenance granted to Mst. Iqbal Suraiya Begum does not arise. Janni Bibi v. In view of the fact that the order of the Court below is patently illegal and unjust, this would be a fit case to invoke the powers of this Court under section 482 of the new Code to set it aside. Revision allowed.
