Short Note : 1. By this petition under Article 226 of the Constitution of India, the petitioner sought to challenge the order of the Board of Revenue, Order of the Commissioner and the order of the Sub-Divisional Officer, Bhander as being incomptent. Held: The powers of this Court under Article 226 of the Constitution could not be invoked to perpetuate illegality. The powers given to the High Court are discretionary and would not be exercised in a manner as would defeat the ends of justice or would support an illegal claim. It would also not interfere where it finds that the process of law has been abused to obtain an order. Petition dismissed.
