Short Note : 1. The petition under Article 226 of the Constitution of India was directed against the order of the Tahsildar purporting to act under section 248 of the Land Revenue Code holding inter alia that the petitioner had encroached on the disputed piece of land. Held : Section 50 of the M.P. Land Revenue Code is comprehensive enough wherein the aggrieved party can invoke the revisional jurisdiction when the proceedings by the revenue officers are irregular or have been started without jurisdiction. Further this Court sees that the order passed by this Court in a petition under Article 226 could, in the same manner be passed by the revisional authority. This Court, therefore, holds that the petitioner had an equally efficacious remedy by virtue of section 50 of the M.P. Land Revenue Code, and he having not availed of that remedy, the petition abates. Petition dismissed.
