Short Note : The case was fixed for evidence. On that date the applicant did not appear in the Court nor had kept his witnesses present, and his counsel applied for adjournment on the ground that the plaintiff was not in Indore and was held up in Onkareshwar. The trial Court rejected the application and dismissed the suit in default. Held : It was admitted on behalf of the applicant that an application has also been filed by him under Order 9, rule 9 CPC for restoration of the suit and it is still pending. Thus the plaintiff having availed of that remedy, this Court is of opinion that this is not a fit case in which the powers under section 115 CPC should be exercised by this Court. Revision dismissed.
