Short Note : 1. The petitioner was Vice-chairman of Krishi Upaj Mandi Samiti, Rampura. Director of Marketing issued a notice to the petitioner to show cause why he should not be removed under section 55 (1) Of the Madhya Pradesh Krishi Upaj Mandi Adhiniyam. 1972. The Director came to the conclusion that the petitioner had retained the amount of Rs. 3,006.70 with him contrary to financial rules and removed the petitioner from the membership of the Samiti. 2. Held: The charge on which the petitioner has been removed is that he retained the amount of Rs. 3,006 70 with him contrary to the financial rules. It was stated by the learned Government Advocate that the Mandi Committee has not framed any financial rules and that the Government Financial Rules are not applicable to the Samiti. It is thus clear that there are no financial rules applicable to the Samiti. The petitioner therefore, could not be held guilty of violation of any such rules. The order is thus apparently erroneous.
