Short Note : 1. The petitioner who was a confirmed Overseer was promoted to the post of Assistant Engineer temporarily until further orders on adhoc basis in officiating capacity. But subsequently the petitioner was reverted to his original substantive post. Held : The order reverting him to the substantive post does not cost any aspersion on the petitioner and there was no reduction in rank since the petitioner was holding the higher office in officiating and temporary capacity. 2. Therefore, the action taken against him does not amount to any punishment, that is dismissal or removal, or reduction in rank so as to attract the provision of Art. 311 of the Constitution. R. S.
