Short Note : 1. It has been held by this Court that there must exist emergency before an order for attachment can be passed under section 145 (4) of the old Code and an order not fulfilling this requirement is contrary to the provisions of section 145 (4) of the old Code, Under the present Code the attachment order can only be passed on fulfilling any of the conditions laid down in section 146 (1) of the Code. Therefore, the order dated 4-11-1976 attaching the land and appointing Supratdar and the subsequent order revising the appointment of Supratdar are set aside. State v.
