Short Note : 1. Learned counsel for the petitioner contended that the question as to what course should be adopted when the enquiry is proper but the employee is punished by an authority not competent to punish him, is not covered by any decision of the Supreme Court and, therefore this Court should certify this case for appeal under Article 133 of the Constitution. Held : It may be that the conclusion reached by the Court is not covered by any direct decision of the Supreme Court, yet this Court does not feel that the question involved is either substantial or that it needs to be decided by the Supreme Court within the meaning of Article 133 of the Constitution. Petition dismissed.
