Short Note : 1. Having regard to the circumstances of the case, the appellant cannot rely upon that part of the statement of the plaintiff and his witnesses which relates to Khasra No. 1372 without also accepting the statements made by them in connection with Khasra No. 1311. The statements of the plaintiff and his witnesses relating to possession if the lands in suit were made in context of exchange. When the exchange is not accepted, it is not open to rely upon these statements for inferring possession. Appeal dismissed.
