Short Note : 1. After hearing the arguments of both the counsel, this Court is of the opinion that the learned trial Judge has arbitrarily rejected the application moved by the plaintiff for discovery of certain documents. The trial Court has not given any reason as to how the documents sought for were not necessary. 2. Written statement has already been filed. The documents sought to be allowed are apparently material and relevant. Since the order impugned is arbitrary, it is open for interference in revision.
