Short Note : 1. Regarding the appellant Badriprasad alias Mantha, a Thali was discovered on his memorandum Ex.P-12 and seizure memo Ex.P-10. This is the Muradabadi Thali with the inscription Special gem. A Muradabadi Thali is mentioned as a stolen article in the list Ex.P-2 and Rajaram (PW-1) has identified this Thali as belonging to him. Thus a Thali which was stolen was found in possession of the appellant Badriprasad alias Mantha for the possession of which he could offer no explanation. His conviction under section 411 of the IPC is therefore in order. The sentence of six month's rigorous imprisonment also appears to be proper. Appeal dismissed.
