Short Note : It was an application under, Order 41, rule 19, read with S.151 C.P.C. for restoration Second Appeal No. 231 of 1971 which was dismissed in default of appearance of the applicant and his counsel on 20-10-1972 when the case was fixed for motion hearing. According to learned counsel for the applicants, he had submitted an application to the Registrar on 12-10-1972 for delisting his cases from 14-10-1972 to 23-10-1972 as he wanted to go out of Indore. It was, therefore, submitted that as he was out of Indore on 20th October 1972 when the case was fixed for motion hearing, he could not remain present in the Court and attend the same. Held : It appears that the counsel for the applicant was vigilant in prosecuting the appeal and had also taken appropriate steps for delisting his cases during his absence in that period. This Court finds that there was sufficient cause for his absence on 20-10-1972. Petition allowed.
