Short Note : 1. By order dated 7-5-1977, the trial Court gave findings on two issues: (i) whether Harbhajan Singh and Weerawati are necessary parties to the suit? and (ii) whether plaintiffs 2 to 4 could not join as parties? The findings went against the defendant. He moved an application for review. That having been turned down, he has come up in revision. Held: In trying those issues, the learned trial Court has ignored the provisions of Order 14, rule 2 of the New Code. Those issues did not relate to the jurisdiction of the Court nor to any bar to the suit created by any law. The issues raised mixed questions of law and fact and the new procedure enjoined pronouncement of judgment on all issues other than a piecemeal trial. Revision allowed.
