Short Note : 1. The decree for judicial separation was sought on the ground that the respondent had treated the petitioner with such cruelty as to cause a reasonble apprehension in the mind of the petitioner that it would be harmful or injurious for the petitioner to live with the respondent. The trial Court, after analysing the evidence of the parties, found that the petitioner had failed to make out any case of cruelty as alleged by him and, in this view of the matter, the trial Court dismissed the petition. Held: To substantiate the charge of cruelty, the petitioner should have established that the conduct of the respondent was sufficiently grave and weighty so as to warrant the description of being cruel justifying grant of a decree for Judicial separation. Appeal dismissed.
