Short Note : 1. It was a report from Shrimati Bina Tiwari, Judicial Magistrate, Khandwa for taking action against Laxman Prasad Shrimali, Advocate, for contempt of Court. The allegation was that in a suit in which Yadunandan Sharma, Advocate, was appearing on behalf of the defendant, in the course of the proceedings in the immediate presence of the Court, Laxman Prasad Shrimali uttered to Yadunandan Sharma ^^rqe Qksjtjh djrs gksA** When Yadunandan Sharma took exception to it, he repeated those words. Yadunandan Sharma then made a complaint of this matter to the Court. The learned Presiding Judge of the Court thought this amounted to contempt of Court and referred the matter to the High Court for taking action. 2. It appears that Laxman Prasad Shrimali has instituted a suit against Madhusudan Sharma, brother of Yadunandan Sharma, for a declaration and permanent injunction restraining the defendant from filing any proceeding on the basis of any forged pro-note and receipt. The plaintiff's contention in that suit (Civil Suit No. 1-A/77 in the Court of Smt. Bina Tiwari, Civil Judge, Class-II, Khandwa) appears to be that there is some pro-note and a receipt which are forged and the plaintiff apprehended a suit to be instituted against him. The learned Counsel for the Contemnor, tells the Court that in fact a suit has been instituted in a Court at Delhi against the plaintiff, under Order 37 of the Code of Civil Procedure. These facts are sufficient to reveal that there was a breeze between the plaintiff and the defendant's Counsel, who is also the defendant's brother in a personal litigation. The words ^^rqe Qksjtjh djrs gks** are no doubt objectionable but in the context of the matter, where the suit itself is based on the allegation that there is some forged pro-note and a receipt, it cannot be said that these words amounted to contempt of Court. In the complaint which was made by Yadunandan Sharma, it is not stated in any detail on what occasion and in what context these words were uttered.
