Gopal Prasad v. Barelal

1977-12-03

SHIVDAYAL

body1977
Short Note : 1. The trial Court issued a temporary injunction. The learned Additional District Judge set aside the order of the trial Court, observing that there was no prima-facie case. For this observation, one of the grounds taken was that the plaintiff did not produce the original sale-deed. 2. This Court has perused the order of the appellate Court. It is vacillating. It has not considered the reasons stated by the trial Court, on which its order was based. The order of the appellate Court was perfunctory. For the ends of justice, the appellate Court must reconsider the appeal and decide it according to law.
