Chintamani Tripathi v. State of M. P.

1977-12-08

A.R.NAVKAR, C.M.LODHA

body1977
Short Note : 1. The learned counsel for the petitioner contended that a copy of the Inquiry Officer's report was not supplied to the petitioner. It was urged that in absence of the Inquiry Officer's report, the petitioner was seriously prejudiced and he could not urge anything to dissuade the authority in respect of the inquiry report. 2. Held : This Court may point out that the petitioner was only a temporary employee and was found to be misbehaving with his immediate officers. He was removed from service as far back as 08-11-1971 and in the opinion of this Court, it is not a fit case where this Court should quash the impugned order on the ground of non-supply of the report of the Inquiry Officer, particularly in view of the conclusion that no prejudice was caused to him by non-supply of the same. State of Maharashtra v. B. A. Joshi, AIR 1969 SC 1302 , relied on. Petition dismissed.
