Short Note : 1. It was an appeal under section 30 of the Workmen's Compensation Act, 1923 against the order of Commissioner for Workmen's Compensation whereby a sum of Rs. 18,000 was awarded as compensation to the applicants-respondents 1 to 4 on account of the death of Ramji, a workman, which resulted from the injury sustained in an accident during the course of his employment. 2. Held: It is urged on behalf of the appellant that the Commissioner erred in law in not giving any direction for the appellant being indemnified by the contractor for his liability to pay the compensation as required by subsection (2) of section 12 of the Act. It may be pointed out that the appellant did not put his claim before the Commissioner to be indemnified. Rule 39 of the Workmen's Compensation Rules, 1924 lays down the procedure for making such a claim. The learned counsel for the appellant could not' point out any provision of law that even in the absence of lodging such a claim, the Commissioner was bound to give a direction to indemnify the appellant The appellant may if so advised, seek the appropriate remedy which may be available to it under the law. Appeal partly allowed.
