Short Note : Exhibit P-2 is the committal Court statement of Dora (P.W.1). Though he was confronted with his committal Court statement, yet the deposition does not disclose that the committal Court statement was brought on the record of the Sessions trial under section 288 of the Code of Criminal Procedure and unless, after due formalities, the statement of the committal Court is brought on record of the Sessions trial under section 288, it cannot become substantive evidence. Appeal allowed.
