Short Note : 1. In the opinion of this Court the prosecution has not at all explained the injuries of the two appellants. The genesis and the origin of the occurrence have been suppressed by the prosecution and the witnesses have thus told lies about the injuries on the two appellants which admittedly was a material factor. The circumstances, as they are injured persons being the aggressor appear to be most probable. In the circumstances the appellant having acted in exercise of the right or private defence is quite reasonably probabilised. The appellants are therefore completely protected and cannot be held guilty for the offences they have been punished. Lakshmi Singh and others v. State of Bihar, AIR 1976 SC 2263 . Appeal allowed.
