Short Note : 1. The lower Court erred in holding that the decree was not executable. The order dismissing the execution application has obviously been passed without any application of mind on the part of the executing Court. If the lower Court had taken the trouble to go through the decree which was sought to be executed. It would not have dismissed the execution application on the ground that the decree was not executable. Case remanded. Appeal allowed.
