Short Note : 1. The grievance made in this revision petition is that certain documents which the applicants sought permission to file were admitted on record subject to costs though the filing of the documents necessitated no adjournment. The trial Court had overlooked the decision of this Court in Union of India v. Khujista Begum, 1976 JLJ Note 11. Costs could not be imposed if hearing was not required to be adjourned. 2. The other grievance was about non-issuance of Commission for a witness in Bombay and one at Chirmiri. The Court could take judicial notice that Bombay was definitely more than 500 Kilometres away. Chirmiri is less than 500 Kilometres from Jabalpur. Commission, therefore, ought to have been issued to the witness in Bombay. Revision allowed.
