Short Note : It is well settled that although a revision petition against an order of the Magistrate under section 146 (B) is maintainable under section 539 Cr.P.C., it is not open to the High Court to interfere with the finding of the Civil Court as to the possession in view of section 146 (1-D). Banmali v. Kanhaiya 1973 JLJ 546 , Bhinka and others v. Charan Singh, AIR 1959 SC 960 relied on. Balram and others v. Durgralal, 1967 JLJ 471 distinguished. Revision dismissed.
