Short Note : 1. The suit was in respect of an insurance policy. The plaintiff had pleaded estoppel on the ground that in the proposal made by the deceased husband, same answers were given in respect of the policy mentioned in issue no. 5. The plaintiff applied for discovery of that policy which was the subject-matter of issue no. 5. The learned trial Judge rejected that application saying that the particulars shown by Late Ranvir Singh cannot be relevant for the policy subsequently taken out by him. 2. The learned trial Judge did not appreciate the scope of Order 11, Rule 12 CPC discovery of a document does not mean that whatever is written in that document will be accepted as true or will be an irrefutable piece of evidence.
