Short Note : Two hostels one for Harijan boys and another for Harijan girls were being run by the Samiti. For running such hostels, the respondents were required to purchase foodstuffs for boys and girls and other materials. On the orders of Moolchand Jaggade, Honorary Secretary of the Samiti, certain articles were supplied by the plaintiff Bhagwandin. It is not in dispute that the amount is with respect to such articles actually supplied by Bhagwandin. The Samiti was receiving grant-in-aid for running the hostels. Obviously, it had no other income or other income was meagre and the back-bone of the Samiti fund was the grant-in-aid received yearly from the Government. On July 1, 1962, the State of Madhya Pradesh took over the management of the Samiti. Held : There is little doubt that the Government was the inter-meddler and became responsible as such to Bhagwandin to the extent of the assets which came in its possession belonging to the Samiti. It received the grant-in-aid and was also in possession of some assets of the Samiti. The learned Government Advocate contended that the Government did not take over the Samiti but was only managing it. That would not relieve the Government of the responsibility to make payment. Admittedly the Government was managing the Samiti and it also received the grant-in-aid. The plaintiff could sue to recover the amount from the inter-meddler to the extent of the assets in its hands. The amount in respect of supplies lawfully made could thus be recovered from the Government to the extent of the assets received by the Government belonging to the Samiti I, therefore, see no reason to interfere with the judgment and decree of the Court below. Appeal dismissed.
