Short Note : The trial Court recorded a part of the compromise only on the ground that the terms relating to payment of amount to the plaintiff by the defendants and regarding dismissal of revenue cases were beyond the scope of the suit. The provisions of Order 23, R.3 CPC, do not provide for recording a compromise in part. Hemant Kumari v. Md. Zawandori Co., AIR 1919 P.C. 79 relied on. Revision allowed.
