Short Note : It was a petition under Article 226 of the Constitution of India by which the petitioner, a student of the H.G.M. Medical College, Indore sought to quash the order dated 26-11-1977 passed by the Dean of the College, whereby he declined to decide an election dispute regarding the election of respondent No.4 Arun Agarwal under Ordinance No. 1 of the University of Indore. In November 1977, elections were held for the Union in which the petitioner as well as respondent No.4 were candidates. According to the results of this election, respondent No. 4 was declared as elected. The petitioner feeling aggrieved with this result submitted an application dated 26-11-1977 challenging the election of the returned candidate on a number of Grounds. The Dean of the College by his order dated 26-11-1977 passed an order to the following effect :- ^^tks dqN gqvk gS vxj og xyr gS rks mldks eSa viuh xyrh ekurk gwWaA vki tks Bhd le>sa] djsaA d`I;k esjh g`n; dh Hkkouk dks le>saA** Held : Clause 6 of the Ordinance specifies the power of the Patron of the Union. Sub-clauses (b) of clause 6 provides that the Patron shall have power to decide all disputes arising out of elections to the General Councilor the Executive Committee referred to him within two days following the day of the declaration of the result of the election and his decision in the matter shall be final. From this provision it would, therefore, be apparent that whenever elections are held for the Union and any dispute is raised with regard to such an election the Patron is by the aforesaid provision of the Ordinance, bound to decide the election dispute. In the instant case, respondent No.3 the Ex-officio Patron of the Union did not even go into the merits of the dispute raised by the petitioner and simply disposed of the application by the aforesaid order. As the dispute raised by the petitioner has not been decided on merits, it would be necessary that the impugned order passed by the Dean should be set aside, and the Patton be directed to decide the dispute raised by the petitioner's application dated 26-11-1977 on its own merits. Petition allowed.
