Short Note : 1. The writ petition by Kishwar Khan was directed against an order of the State Industrial Court, M.P. upholding the order of the Presiding Officer, Labour Court, rejecting his application for reinstatement under section 31 (3) of the M.P. Industrial Relations Act, 1960. Held : The Labour Court, on evidence led by the management i.e. M.P. State Road Transport Corporation, found that the charges under Standard Standing Order No. 12 (1) (Kha), (Gha) and (Cha) of the Standard Standing Orders framed under section 7 of the Act, have been proved. The petitioner was employed as a conductor in the city Depot, Bhopal. He was chargesheeted for having on 20-6-1968 carried 7 passengers without tickets and for having snatched the collection sheet and trip sheet from the Checker. These charges have been held to be proved. The fact that the labour Court disbelieved the explanation offered by the petitioner for not issuing tickets, lends assurance to the inference drawn by the labour Court that his conduct was dishonest and also the fact that he snatched the trip sheets and the collection sheet from the checker. The findings of the State Industrial Court as well as the Labour Court are both based on consideration of evidence. No interference with their orders is called for. Petition dismissed.
