Short Note : 1. In the instant case the evidence goes only to the extent that the aforesaid ammunition was found in the possession of the appellant. The appellant did not have any mouser rifle or sten gun with him. There was no further evidence to show that the possession of the said ammunition was with intent to use the same for any unlawful purpose. Mere possession of the arms or ammunition would not constitute an offence under section 27 of the Arms Act. Amrit Singh v. State of M. P., 1976 JLJ SN 123, Mahendrasingh v. State of West Bengal 1973 CAR 273 (SC) relied on. Appeal partly allowed.
