JUDGMENT 1. - Heard arguments. 2. The only question urged in this revision petition is that the sentence awarded to the accused in respect of an offence under section 16 of the Prevention of Food Adulteration Act, which was committed on June 19, 1975 is excessive. In view of the fact that the accused was a poor man and that even after the bail was granted he could not avail of the bail order due to poverty. 3. The accused has been sentenced to undergo eight months rigorous imprisonment and to pay a fine of Rs. 1000/-, in default to undergo further rigorous imprisonment for three months. 4. Taking into consideration that he was vending small quantity of milk and was earning his livelihood and for the fact that he has been in jail since May 30, 1978, I feel that the ends of justice will be met to reduce the sentence to the period already undergone. So far as the sentence of fine is concerned, taking into consideration the period, I reduce it to Rs. 50/- (Rupees fifty), in default of payment of fine to undergo rigorous imprisonment for one month. 5. The accused is in jail. I, therefore, direct that he shall be set at liberty forthwith.Sentence reduced. *******
