Short Note : 1. The plaintiff-applicant instituted a suit against the defendant-non-applicant for recovery of a sum of Rs. 108. From the record it was clear that summons was served on one Kudrat Khan, cited as a witness by the plaintiff, for attending the Court to give evidence on 19th December 1973, but the said witness failed to appear. The trial Court after recording the evidence, dismissed the suit on that very day. 2. The learned counsel for the applicant, contended that the trial Court erred in law in not taking coercive steps to secure the attendance of Kudrat Khan, who was a material witness. The contention advanced on behalf of the plaintiff-applicant that the trial Court erred in law in failing to comply with the provisions of Order 16, Rule 10, Code of Civil Procedure must be upheld. Case remanded. Revision allowed.
