Short Note : 1. Since all these cases arise out of Crime No. 16/78 under section 148, 302/149 I. P. C. registered at the police-station Jamner in District Guna, they are heard together. Held : Shri Mukherji requests for release on bail of only Ide Khan (petitioner in Miscellaneous Criminal Case No. 189/78) and Narain Singh (petitioner No. 1 in Miscellaneous Criminal Case No 190/78) and that too purely on the ground of their old age. Tile State, however, opposes the request on the ground that mere age should be no consideration in the matter of bail I cannot persuade myself to take it as a rule of thumb. Even according to the prosecution, they are not less than 60 years of age, though their own submission is that they are 70 years of age. Since no overt act is assigned to these two petitioners and since they are of advanced age, I see no harm in allowing their request. The petitioners Ide Khan and Narain Singh be released on each of them executing a bail bond for Rs, 5,000/- with a surety in the like amount for his appearance as per directions of the C. J. M, Guna. Application allowed.
