Short Note : 1. The petitioners under section 407, Clause (1), sub-Clause (c) of the Code of Criminal Procedure pray for transferring Criminal Case No. 1397 of 1977 pending in the Court of Judicial Magistrate, First Class, Baloda Bazar, District Raipur, under section 500 I.P.C., as a result of a private complaint by the respondent Bhogram against them to the Court of Judicial Magistrate First Class, Mahasamund. 2. It is only recently that the villages Magatdeori and Sonpur where the petitioners and the respondent respectively reside have come to fall within the jurisdiction of the Judicial Magistrate First Class, Baloda Bazar. Previously, the jurisdiction had vested in the Court at Mahasamund. The petitioners pray that it will be convenient for the parties that the case be transferred to the Court of Judicial Magistrate First Class, Mahasamund. They had moved a similar application before the Sessions Judge, Raipur also under section 408 Criminal Procedure Code, but to no effect. 3. Held: Considering that Mahasamund is at a shorter distance than Baloda Bazar from the two villages Magatdeori and Sonpur where the petitioners and the respondent respectively reside and that even though there is a shorter route to reach Baloda Bazar from these villages, but one has to traverse about 25 miles on foot, thus, in the process entailing a waste of one day, I find that it would be expedient and to the convenience of the parties and witnesses that the Criminal Case No. 1397 of 1977 pending before the Judicial Magistrate First Class, Baloda' Bazar be tried by the Judicial Magistrate First Class, Mahasamund. Application allowed.
