Short Note : By this petition under Article 226 of the Constitution, the petitioner challenges the order, dated 19th May 1973, passed by the State Government by which a minor punishment of stoppage of two increments without cumulative effect was imposed on him. 2. It will be seen that the gravamen of the charge, which was held proved against the petitioner, was that in spite of repeated orders of the Collector, the petitioner did not hand over charge to his successor and did not join his duties at the place where he was transferred. It is for this act that the petitioner was punished. 3. Held: The learned counsel for the petitioner referred to various circumstances to show that there were good reasons for the petitioner not to join his duties at the place of transfer. These circumstances have already been taken into account by the Public Service Commission in tendering its advice to the State Government for taking a lenient view. In any case, we have no jurisdiction to interfere in the matter of punishment when there is no contravention of any statutory rule or provision. Petition dismissed.
