Short Note : This is a revision directed against order passed by the Second A.D.J., Gwalior acting as Small Cause Judge dated 18-12-1972 in M.J.C. No. 24 of 1971 whereby application of the plaintiff applicant for restoration of the suit has been rejected holding it to be time barred. Held : Application under section 5 of the Indian Limitation Act which is duly supported by an affidavit disclosed the fact that the delay was occasioned due to mistake of calculation. The mistake of calculation cannot be styled as mala fide. To err is human. The calculation at times can be wrong. Therefore, there was no reason to disbelieve the application in this matter. There is not even counter-affidavit. Consequently, sufficient cause exists to condone the delay of one day, occasioned in filing application for restoration. 2. In this view of the matter, the impugned order is set aside and delay of one day occasioned in filing restoration application is hereby condoned. Consequently, the Small Cause Judge is directed to decide the application for restoration on its merits now. Revision allowed.
